If you do not agree with the Terms, please refrain from proceeding with the purchase. If you have already made the purchase, you may request a refund within the cooling-off period, as per article 49 of the Consumer Protection Code.

1. PARTS:

PRODUCTION COMPANY: Aquiles Priester , registered under CNPJ number 12.348.391/0001-19, headquartered in São Paulo - SP, herein represented by its managing partner, Aquiles Priester , hereinafter referred to as the CONTRACTED PARTY.

PRODUCER : Bigbot Informática Ltda, registered under CNPJ number 50.642.455/0001-89, headquartered in Indaiatuba – SP, herein represented by its managing partner, André Luís de Oliveira Neves, hereinafter referred to as PLATFORM.

PAYMENT GATEWAY :

- ASAAS - registered with the CNPJ under number 19.540.550/0001-21, headquartered in Joinville - SC, hereinafter referred to as Gestão Financeira Instituição de Pagamento SA

- Stripe - registered with the CNPJ under number 22.121.209/0001-46, headquartered in São Paulo - SP, hereinafter referred to as Brasil Soluções de Pagamento Ltda. - Payment Institution

- Pagar.me, part of the StoneCo Group, registered under CNPJ number 18.727.053/0001-74, with headquarters in São Paulo - SP, hereinafter referred to as a Payment Service Provider (PSP).

USER-STUDENT: The beneficiary of the use of the digital product, identified through the information provided to the payment platform at the time of purchase, hereinafter referred to as the CONTRACTING PARTY.

This Agreement establishes the provisions governing the rights and responsibilities associated with the purchase and use of the digital product entitled " Unveiling the Double Drum Technique and Career Management & Music Marketing " and the corresponding supplementary materials.

This document will be accessible to the USER-STUDENT at all times through the Bigbot Platform on the page called "Terms of Use," always visible in the portal's footer. The USER-STUDENT will have full access before the expiration of the withdrawal period stipulated in Article 49 of the Consumer Protection Code. The USER-STUDENT may read the Terms and decide to terminate the INFOPRODUCT with a full refund, provided that this is done within the established withdrawal period of 7 (seven) consecutive days in total, including the period stipulated in Article 49 of the Consumer Protection Code.

The Terms will also be sent to the WhatsApp group (or other), allowing the USER-STUDENT the opportunity to read the Terms and decide on the termination of the INFOPRODUCT.

2. OBJECT:

The resources are offered, developed, managed, and owned by the PRODUCER and consist of the following deliverables:

3. ACQUISITION, PRICE AND PAYMENT:

The purchase of the INFOPRODUCT will be made through the Asaas, Stripe, or Pagar.me platform via the link generated on the page: URL LP VENDAS or https://aquilespriester.bigbot.com.br. The total investment for the INFOPRODUCT corresponds to the amount available on the sales page, which can be paid through the available payment options Asaas, Stripe, or Pagar.me, as previously chosen by the USER-STUDENT.

3.1. By opting for installment payments for the INFOPRODUCT, the USER-STUDENT declares to be aware and in agreement that access to and use of the infoproduct are not linked to the number of installments chosen. The course may be completed within a different timeframe (shorter or longer) than the installment plan. Therefore, there will be no right to reimbursement, discount, or refund if the USER-STUDENT, through their sole responsibility, does not complete the course during the period in which access to the infoproduct is available.

3.2. The USER-STUDENT agrees that, by opting for payment in installments, the completion of the INFOPRODUCT does not interrupt or exempt their obligation to pay all installments assumed. Full payment is due regardless of when the course is completed.

3.3. Under no circumstances - unless expressly authorized in writing by the PRODUCER via official email alunos@bigbot.com.br - may the USER-STUDENT request a chargeback (refund) of the purchase made on their credit card, under penalty of applicable civil and/or criminal legal action.

3.4. The USER-STUDENT declares that they are aware that, in case of default on the obligations stipulated in this Agreement, the PRODUCER may adopt all applicable legal measures, including registering the USER-STUDENT's name in defaulter databases, as well as filing relevant civil and/or criminal lawsuits. Furthermore, the USER-STUDENT's access to the INFOPRODUCT Platform and groups may be blocked until the debt is fully paid, without this relieving them of the obligation to pay the total value of the INFOPRODUCT.

4. ACCESS:

To access the INFOPRODUCT and other supporting materials and content, the USER-STUDENT must register through the Infoproducer platform on the Bigbot platform (https://aquilespriester.bigbot.com.br) via a link received in the registered email within 24 (twenty-four) consecutive hours after confirmation of purchase, providing all mandatory information requested by the PRODUCER and/or the Bigbot platform, by creating a login and password containing name, CPF (Brazilian tax identification number), address, email, and telephone number.

4.1. The USER-STUDENT assumes full responsibility for the information provided during registration, guaranteeing the truthfulness and accuracy of this data. The PRODUCER is not responsible for incorrect or false information provided by the USER-STUDENT. It is important to emphasize that the USER-STUDENT confirms that, in case of any discrepancy in the information provided, their access to the INFOPRODUCT may be impaired until access instructions are provided, and in case of any access problems, they should contact us via email: alunos@bigbot.com.br.

4.2. The digital product was acquired for the specified period according to the plan purchased, starting from the date of purchase.

4.3. Access to the INFOPRODUCT is not a continuous service, and all recorded classes and document templates will be available on the Platform from the access period onwards, with live classes considered a bonus, and their execution is linked to the USER-STUDENT's interest in accessing the INFOPRODUCT, not to participation.

4.4. The INFOPRODUCT and other content are for personal, individual, and non-transferable use. The STUDENT-USER may not lend, assign, record without authorization – even for their own use – or share them, under penalty of civil and/or criminal liability. This includes the use of Document Templates, which may not be shared with non-student third parties.

4.5. Access to the INFOPRODUCT and groups may be suspended, interrupted, or canceled by the PRODUCER without prior notice in cases of:

(i) delay of 02 (three) installments in payment;

(ii) violation of the rules of conduct established in clause 4.6;

(iii) password sharing;

(iv) in case of suspicious activities;

(v) for investigation of irregularities;

(vi) for maintenance, with nothing being owed by the PRODUCER as a result of such suspension, interruption or cancellation.

4.6. The USER-STUDENT has the right to access the WhatsApp group and/or another platform to be defined by the PRODUCER (such as, but not limited to, "Telegram") and exchange experiences through electronic messages for an indefinite period, as long as the group exists, free of charge. The PRODUCER reserves the right to terminate the Group and the sale of info-products without prior notice, always complying with the agreed terms of validity of the contracted plan.

4.7. The PRODUCER undertakes to respond to all messages relating to the topic " Unveiling the Double Drum Technique and Career Management & Music Marketing " in the Group within 5 (five) business days.

4.8. The USER-STUDENT agrees not to share on the Bigbot Platform or in groups on any social network and/or electronic messaging applications content that encourages crime or any form of violence or discrimination.

4.9. The STUDENT-USER agrees to respect the laws, terms, and regulations of the "Platforms" and other websites, refraining from sharing content that encourages crime or any form of violence, contains viruses, messages of a political or religious nature, false or disrespectful religious information, or that disturbs other STUDENT-USERS. The PRODUCER reserves the right to remove content shared in violation of the rules and to exclude the STUDENT-USER from groups and Platforms, without prior notice and without prejudice to any eventual contract termination without reimbursement of amounts.

4.10. The contracted access period for the INFOPRODUCT purchased by the USER-STUDENT begins at the time of purchase and is continuous, with no suspension periods allowed.

4.11. The STUDENT-USER may request course renewal by emailing alunos@bigbot.com.br, which may be offered at any price determined by the PRODUCER, without any guarantee of discounts or maintenance of the same price as the first purchase.

5. INTELLECTUAL PROPERTY:

5.1. The INFOPRODUCT is made available to the USER-STUDENT in a non-exclusive, limited, and exclusively informational, learning, and strictly personal and non-commercial use. The acquisition of the INFOPRODUCT does not imply, under any circumstances, the transfer of intellectual property rights over the course or any of its contents, including support materials, texts, videos, audios, designs, images, photographs, layouts, algorithms, graphics, e-books, books, trademarks, logos, trade names, advertising materials, and distinctive signs belonging to the PRODUCER or third parties who have authorized their use. These materials are protected under current legislation and applicable international treaties.

5.2. The USER-STUDENT agrees not to reproduce, copy, store, transmit, display, disseminate, edit, commercialize, assign, license, or alter these materials without the prior and express authorization of the PRODUCER, by any means or format. Failure to comply with these provisions will subject the USER-STUDENT to the civil and criminal penalties provided for by law, and they must always respect the Brazilian and international legal framework applicable to the protection of intellectual property, as well as these Terms and any specific regulations of the platforms or websites used in connection with the INFOPRODUCT and its materials.

5.3. The STUDENT-USER is exceptionally authorized to record short clips of up to 1 (one) minute from the classes for posting on their personal and professional social media profiles, always making it clear that they are a STUDENT of Expert Aquiles Priester .

5.4. The USER-STUDENT is authorized to disclose that they are a STUDENT of Expert Aquiles Priester on their social networks, professional profiles, and resume.

6. OBLIGATIONS OF THE PARTIES:

6.1 In addition to the obligations stipulated by law and the other obligations set forth in these Terms, the USER-STUDENT shall:

a. Possess and properly configure the computer equipment and peripherals necessary for the object of these Terms to be provided (any questions regarding the minimum requirements for accessing the course should be clarified by the USER-STUDENT through the customer service channel alunos@bigbot.com.br);

b. Keep your registration information updated with the PRODUCTION COMPANY;

c. Do not share, sell, or transfer your access to the INFOPRODUCT to third parties unrelated to this commercial relationship, maintaining the confidentiality of your login and password;

d. Access the INFOPRODUCT only online and exclusively through the Bigbot Platform, without making copies by any means, including downloading or screen recording;

e. Make payments according to the purchase;

f. Respect the rules of social interaction and conduct, including within groups;

6.2. In addition to the obligations stipulated by law and the other obligations set forth in these Terms, the PRODUCER shall:

a. To provide the USER-STUDENT with access to the INFOPRODUCT, provided that the USER-STUDENT fulfills their obligations and has not committed a serious offense that justifies blocking access;

b. To offer support to the USER-STUDENT regarding technical access issues and/or problems on the platform, as well as pedagogical issues, which will include assistance from the INFOPRODUCT Expert within a response time of 05 (five) business days via email alunos@bigbot.com.br;

7. RIGHT OF WITHDRAWAL:

Within 7 (seven) calendar days after the date of purchase, the USER-STUDENT may request the termination of the contract and reimbursement of the amount paid by email to alunos@bigbot.com.br with a response time of 5 (five) business days, with the amount being reimbursed in the same way it was paid (whether in full or in installments) within 5 (five) business days for payment of the first installment.

7.1. If the USER-STUDENT is dissatisfied with the INFOPRODUCT at the end of the contracted validity period, for any reason, each USER-STUDENT will be entitled to 01 (one) 01 (one) hour session with Expert Aquiles Priester to develop a practical professional action plan, which must be strictly followed by the USER-STUDENT, with no further recourse after that.

7.2. Clause 7.1 is a concession from the PRODUCER and does not guarantee results.

8. Regarding the General Data Protection Law:

8.1. By accepting this agreement, the USER-STUDENT unequivocally authorizes and consents for their personal data (name, CPF [Brazilian tax ID], email, image, voice, and telephone number) to be processed by the PRODUCER in accordance with Law No. 13.709/2018 (General Data Protection Law), which may be used for the following purposes:

(i) Identification of the STUDENT-USER;

(ii) Payment authorization;

(iii) Respond to requests and questions;

(iv) To cooperate with and/or comply with a court order or request from an administrative authority;

(v) Disclosure of Social Proof attesting to the quality of the INFOPRODUCT;

(vi) Sending gifts and promotional materials;

(vii) Sending recorded classes on the Bigbot Platform;

8.2. The use, access, and sharing of personal data will be done within the limits and purposes of the PRODUCER's activities, and the USER-STUDENT may, at any time, by request via email to alunos@bigbot.com.br:

(a) To have access to the data;

(b) To demand the correction of incomplete, inaccurate or outdated data;

(c) Request the anonymization, blocking or deletion of unnecessary, excessive or processed data in violation of Law No. 13.709/18 or that were used without their authorization;

(d) Request the portability of data to third parties and obtain information from the third parties with whom the data has been shared;

(e) Revoke, at any time, consent for the processing of your data, bearing, in the latter case, the sole responsibility for the impossibility of fulfilling the obligations and rights of this instrument, for which data is necessary.

8.3. The USER-STUDENT is hereby informed that the revocation of data may impair the proper provision of the INFOPRODUCT, since the CLASSES WILL BE RECORDED WITH THE PARTICIPATION OF THE USER-STUDENTS and if the USER-STUDENT does not agree with the exposure of their name, image and voice, they should not participate in the LIVE CLASSES but rather watch the recorded ones.

8.4 Revocation of consent may only be carried out up to 1 (one) business day before each live class, as after recording, the classes will be available on the Bigbot Platform for all students, and may be used in the future for new classes. If the STUDENT-USER has any justifiable reason for revocation, they must contact alunos@bigbot.com.br via email.

8.5 The STUDENT-USER may keep their camera and audio off and omit their name during the LIVE CLASS if they wish to have the full experience without disclosing their data, and it will be their sole responsibility to omit their data to avoid exposure.

9. ASSIGNMENT OF IMAGE AND VOICE RIGHTS:

By accepting this agreement, the USER-STUDENT authorizes the capture and use of their image, name, video, voice, text, and testimony, especially as a result of participation in the INFOPRODUCT and related events. The PRODUCER may record, edit, and reproduce these documents without any limitation and without any compensation being owed to the USER-STUDENT.

10. COMPETITION AND NOT SOLICITATION:

The USER-STUDENT agrees and undertakes not to engage in any act that constitutes competition with the products, services and/or content of the PRODUCER, for a minimum period of 01 (one) year from the date of termination of the USER-STUDENT's access to the infoproduct, as well as undertakes not to recruit specialists or clients of the PRODUCER; if a violation occurs, they will be notified to remedy the irregularity within 30 (thirty) calendar days, under penalty of the sanctions provided for in the legislation.

11. EXCLUSION OF LIABILITY:

The digital product is made available digitally; therefore, the USER-STUDENT is fully aware that the PRODUCER cannot guarantee the full functionality of these third-party channels and is not responsible for any damage resulting from access to the Platform, hacker attacks, server loss, unavailability, or any other related event.

12. EXCLUSION OF WARRANTIES:

The purchase of this INFOPRODUCT does not guarantee any type of intellectual, professional, financial, or personal advancement for the USER-STUDENT, nor does it guarantee any type of result, financial gain, or professional success, being considered an obligation of means. This Agreement only constitutes the sale and delivery of the items mentioned in clause 2 - OBJECT - pertaining to the topic " Unveiling the Double Drum Technique and Career Management & Music Marketing ".

12.1. The USER-STUDENT expressly declares that they are aware that the content made available to them reflects the knowledge and personal opinions of Expert Aquiles Priester regarding the subjects discussed, and that there is no guarantee that the content is absolute truth, nor does it assure any practical result.

12.2. The PRODUCER may replace any module or other lesson it deems relevant to the INFOPRODUCT, provided that it gives 5 (five) business days' prior notice, and is not obliged to maintain the content initially disclosed in the sale, but is obliged to conduct lessons on the topic " Unveiling the Double Drum Technique and Career Management & Music Marketing " and open a vote in the Whatsapp Group so that the majority of students choose the new topic.

12.3. The PRODUCER may replace Expert Aquiles Priester in the event of personal and/or family illnesses, death of close friends and/or family members, problems with internet signal and/or computer equipment and/or any unforeseen event that makes it impossible for the scheduled classes to take place, undertaking to make its best efforts to reschedule the class and/or replace it with an Expert with similar and/or superior knowledge, and must justify and prove through documents the reason why Expert Aquiles Priester is unavailable.

13. CERTIFICATE:

The Platform will issue the USER-STUDENT a certificate of completion exclusively in electronic format, upon completion of 100% (one hundred percent) of the content made available in the INFOPRODUCT; however, the USER-STUDENT declares their full awareness that the PRODUCER has no connection whatsoever with the Ministry of Education (MEC), offering only INFOPRODUCTS that are not subject to regulation by said body.

14. GENERAL PROVISIONS:

14.1. This instrument does not imply the formation of any type of company, association, or any type of work or employment relationship, nor does it establish any responsibility between the parties beyond the provision of the CLASSES MENTIONED IN CLAUSE 2.

14.2. If any part of this agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.

14.3 If any part of these "Terms" is deemed invalid or unenforceable, such part shall be interpreted in a manner consistent with applicable law to reflect, as closely as possible, the original intent of the PRODUCER and the STUDENT-USERS, so that the remaining provisions shall remain in full force and effect.

14.4. These "Terms" may be modified and/or altered periodically, in whole or in part, by the PRODUCER, upon prior notice to the USER-STUDENT.

14.5. The tolerance by either party of the other party's inaccurate fulfillment of the obligations assumed in this instrument, or its failure to demand or apply the respective penalty, shall not imply a waiver or release of the obligation or its penalty, nor shall it constitute an innovation.

14.6. All notifications and communications from the PRODUCER to the USER-STUDENT will be considered effective, for all purposes, when sent to the email address provided during registration on the Bigbot Platform, and it is the USER's responsibility to inform of any changes via email: alunos@bigbot.com.br .

14.7 The USER-STUDENT authorizes the PRODUCER to create direct or indirect communication channels, including email, social networks, mobile notifications and other methods, so that the PRODUCER can keep the USER-STUDENT informed about its services in the best possible way.

14.8. The PRODUCER may make any changes to the platform or infoproduct as it deems necessary, without this causing any harm to the USER-STUDENT.

15. STUDENT-USER DECLARATIONS:

The USER-STUDENT expressly acknowledges that the mere availability of the INFOPRODUCT content constitutes full compliance with the PRODUCER's obligations, regardless of actual viewing.

15.1. By accessing and registering on the Platform, the USER-STUDENT declares to be a natural person, to be at least 18 (eighteen) years of age, and also attests to being legally capable of understanding, accepting and complying with this agreement.

15.2. By sending the Terms of Use to the registered email address, regardless of proof of receipt or continuation of classes, the USER-STUDENT expresses having read and understood these terms and other legal instruments mentioned and made available, assuming the rights and obligations established, and accepts these Terms for all legal purposes.

15.3. Acceptance of these Terms will occur with the Purchase of the INFOPRODUCT through the BigBot Platform customized for Aquiles Priester , it being understood that these Terms are fully available for reading and agreement before and after the Purchase period.

16. FORUM:

These Terms shall be governed by Brazilian law, and the Court of Indaiatuba, State of São Paulo, shall have exclusive jurisdiction to resolve any doubts or disputes arising from these Terms, to which the USER-STUDENT expressly consents and waives jurisdiction over any other, however privileged it may be or may become.

If any questions arise regarding the content of this document, the STUDENT may contact the PRODUCER via email: alunos@bigbot.com.br with a response time of 05 (five) business days.

It is important to note that this document complements the Terms of Use of the Asaas, Stripe, Pagar.me and Bigbot platforms and, in case of discrepancy, the PRODUCER's Terms of Use will prevail.
